1963 Chap. 0672. 565 dredths (710.00) feet, to point, thence 48?-o8'-05" five hundred forty and no one hundredths (540.00) feet to point, in the southerly sideline of Gilbertville Road, thence 47?-25'-38" along said southerly sideline of Gilbertville Road one hundred forty and no one hundredths (140.00) feet to the point of beginning. No source of water supply and no lands necessary for protecting and preserving the purity of the water shall be taken or used under the authority of this act without first obtaining the advice and approval of the state department of public health. The location and arrangement of all dams, reservoirs, wells or filter galleries, filtration and pump-' ing plants, or other works, necessary to carry out the provisions of this act shall be subject to the approval of said department. Said district may construct and maintain on the lands acquired and maintained under this /act proper dams, wells, reservoirs, pumping and filtration plants, buildings, standpipes, tanks, fixtures and other structures, including also purification and treatment works, the construction and maintenance of which shall be subject to the approval of said department of public health. Said district may enter upon any lands for the purpose of making surveys, test wells or pits and borings, and may take or acquire the right to occupy temporarily any lands necessary for the construction of any work or for any purpose authorized by this act. Said district may construct, lay, repair and maintain conduits, pipes and other works on and over any lands, water courses, public or other ways, and-ajq-iig any such way in said town, in such inarm er as to carry out the purposes of this act; and for the purpose of constructing, laying, repairing and maintaining apparatus and laying and repairing conduits, pipes and other works, and for all other purposes of this act necessary and incidental thereto and therewith, said district may enter upon and dig up or raise and embank any such lands,highways or other ways in such manner as to permit public travel hereon; provided, that said district shall restore, to as good condition as they formerly were in, any ways so dug up. Said district shall pay all damages sustained hy any person in consequence of any negligent act upon the part of the said district, its agents or employees under this act. Section 2. Nothing in this act shall limit any right of the town of New Braintree heretofore granted or which may hereafter be granted, to supply itself and its inhabitants with water from any source within its limits; provided, that such acts by said town shall not interfere with such water supply as may be established and required by the Gilbertville Water District.
