1965 Chap. 0899. commonwealth shall, together with interest thereon at the rate of six per cent per annum, constitute debt due the commonwealth, upon the rendering of an account therefor to the owner of record, and shall be recoverable from such owner in an action of contract. Any such debt, including interest thereon, shall constitute lien on the property involved, if notice of such lien is recorded on behalf of the commonwealth in the proper registry of deeds within ninety days after the debt becomes due. Any proceeding under this section may be advanced for speedy trial. Section 4. Notwithstanding any contrary provision of law, in any action of summary process to recover possession of certain premises occupied for dwelling purposes where the tenancy has been terminated by notice to quit for nonpayment of rent, no judgment and execution shall issue for the plaintiff while the rents payable for said premises are to be paid into court pursuant to an order issued under section one hundred and twenty-seven or one hundred and twenty-seven of chapter one hundred and eleven of the General Laws and are so being paid, nor during the nine month period next following the date said order ceases to be operative or is revoked. Section 5. The provisions of this act are severable, and if any of its provisions shall be held unconstitutional by any court of competent jurisdiction, the decision of such court shall not affect or impair any of the remaining provisions.
