The amount of tidewater, displaced or to be displaced by any structure below highwater mark or by any filling of flats, shall be ascertained by the department which shall require the licensee to pay to the commonwealth before the license shall become effective such amount, if any, as shall be assessed by the department with respect to such displacement, in accordance with the provisions of chapter ninety-one of the General Laws, and each such license granted by the department shall contain recitation that such assessment has been made and payment received. Section 5. Nothing herein shall affect or impair the powers and responsibilities of the department with respect to tidewaters within any portion of the area covered by such plan which is not subject to license granted as provided in section three.
