1974 Chap. 0840. of annual contributions authorized by general law or this act, to convey to the federal government the project to which such contract relates, upon the occurrence of substantial default with respect to the covenants, terms, and conditions of such contract to which the city or the authority is subject. Such contract may further provide that, in case of such conveyance, the federal government may complete, operate, manage, lease, convey, or otherwise deal with the project in accordance with the terms of such contract, provided that the contract shall require that, as soon as practicable, after the federal government is satisfied that all of the defaults on account of which it acquired the project have been remedied, and that the project will thereafter be operated in compliance with the terms of the contract, the federal government shall reconvey to the city or the authority the project in the condition in which it then exists. The obligation of the city or the authority under such contract shall be subject to specific enforcement by any court having jurisdiction. Section 14. The provisions of this act are hereby declared to be severable and if any such provision or the application of such provision to any person or circumstances shall be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not be construed to affect the validity or constitutionality of any of the remaining provisions of this act or the application of such provisions to persons or circumstances other than those as to which it is held invalid. It is hereby declared to be the legislative intent that this act would have been adopted had such invalid or unconstitutional provisions not been included therein. It is hereby further declared to be the legislative intent that all rights and powers given to redevelopment authorities under the provisions of any laws which do not conflict with specific provisions of this act shall be given to the community development authority and that all rights and powers given to housing authorities under the provisions of any laws which do not conflict with the specific provisions of this act, other than those relating solely to operation, management and maintenance of housing projects, shall be given to the community development authority. Section 15. Upon the passage of this act, all moneys, furniture, fixtures, supplies, equipment, contractual obligations, and rights of the Medford redevelopment authority shall be assigned, transferred, and delivered to the Medford community development authority. 1974 Chap. 0838. An Act Relative To Certain Irrevocable Licenses In Certain Tidewaters Of Boston Harbor Adjacent To The Reserved Channel In The South Boston District Of The City Of Boston.

1974 Chap. 0837. thence 28-52-13 E, 117.04 feet to stake and tack; thence 17-25-55 W, 74.99 feet to drill hole; thence 72-34-05 W, 264.16 feet to the point of beginning. Containing 77,000 sq. ft. more or less. Section 1a. There shall be retained by said commission the perpetual right and easement to construct, inspect, repair, renew, replace, operate and forever maintain covered sewers, constructing sewers and drains with their proper manholes, embankments, walls, culverts and other appurtenances in, through, and under the described property and for access for the removal of screenings from the Ward street head works. Unless the written consent of said commission or such other authority having the control and management of said easements on behalf of the commonwealth, shall first have been obtained, no buildings or structures or foundations of buildings or structures or parts thereof shall be erected or maintained upon any part of said easement. Section 2. This act shall take effect upon its passage. Approved August 13, 1974. Chap. 0837. An Act Authorizing The Temporary Determination Of Free Cash Resulting From The Change In The Fiscal Cycle. Whereas, The deferred operation of this act would tend to defeat its purpose, which is to allow cities and towns to adjust the free cash as set forth herein, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
