1975 Chap. 0884. 1333 employer may, at any time before an award of workmen's compensation benefits or approval of lump sum settlement is paid, file with the division claim for reimbursement out of the proceeds of such award or lump-sum settlement. In those instances in which such claim is filed, said accident and health insurer or hospital, medical or dental service corporation or employer shall have lien against the award, or lump sum, and upon satisfactory proof, the division or member thereof shall order direct payment of the reimbursement to be made from such award or lump sum to the employer, health or accident insurer or hospital, medical or dental service corporations who paid or furnished such benefits. When lump sum settlement is proposed and the employee and the lienholder are unable to agree on fair and reasonable amount to discharge lien against the lump sum settlement under the provisions of this section then either the division or member thereof shall have the right to determine the fair and reasonable amount to be paid out of the lump sum settlement to discharge the lien. Upon the payment of such sums as is found to be fair and reasonable, the lien or claim shall be discharged. In no event shall the reimbursement exceed the amount of the award or lump sum.
