Chap. 0013 AN ACT FOR APPORTIONING AND ASSESSING A TAX OF ONE HUNDRED AND ONE THOUSAND EIGHT HUNDRED AND SEVENTY-ONE POUNDS ONE SHILLING AND TWOPENCE HALFPENNY, UPON THE SEVERAL TOWNS AND OTHER PLACES IN THIS STATE HEREINAFTER NAMED FOR DEFREYING THE PUBLIC CHARGE [SJ; AND ALSO FOR ASSESSING A TAX OF SEVEN THOUSAND THREE HUNDRED AND TWENTY POUNDS SEVENTEEN SHILLINGS, PAID THE REPRESENTATIVES FOR THEIR TRAVEL AND ATTENDANCE IN THE GENERAL COURT IN THE YEAR ONE THOUSAND SEVEN HUNDRED AND SEVENTY-FIVE: ALSO FOR ASSESSING A TAX OF FORTY POUNDS ONE SHILLING ON THE TOWN OF HANCOCK, TO PAY A COMMITTEE APPOINTED BY THE GENERAL COURT TO GO TO SAID TOWN. Whereas it is necessary that the aforesaid sums of one hundred and nine thousand two hundred and thirty-one pounds nineteen shillings and twopence halfpenny, should be raised and paid into the public treasury of this state, as soon as may be, to defrey such public charges as have arisen, or may arise,for the support of government; therefore, for the ordering, directing and effectually drawing into the treasury the said sum of one hundred and nine thousand two hundred and thirty-one pounds nineteen shillings and twopence halfpenny, - Be it enacted by the Council and House of Representatives in General Court assembled, and by the authority of the same, [Sect. 1.] That each town and other place within this state be assessed and pay, as such town and other place's proportion of the sum of one hundred and nine thousand two hundred and thirty-one pounds nineteen shillings and twopence halfpenny, the following sum set against them, respectively ; that is to say, - y IN THE COUNTY OF SUFFOLK. And be it further enacted by the authority aforesaid, [Sect. 2.j That the treasurer do forthwith send out his warrants, directed to the selectmen or assessors of each town or other place, within this state, that are taxed, requiring them, respectively, to assess the sum hereby set upon such town or other place, in manner following ; that is to say, to assess all male polls above the age of sixteen years, within their respective towns or other places, or next adjoining to them, belonging to no other town or place, including negroes and molattoes (and such of these that are under the government of a master or mistress, to be taxed to the said master or mistress, respectively, in the same manner as minors and apprentices are taxed), at nine shillings ; and proportionably in assessing the additional sums paid out of the treasury to the representatives, for their travel and attendance aforesaid (excepting the president, fellows, professors, tutors, librarian and students of Harvard College, who have their usual residence there, and settled ministers of the gospel, who are hereby exempted, as well from being taxed for their polls, as their estates being on their own hands, and under their actual management and improvement, and in the parishes where they are settled ; as also the estate belonging to Harvard College) ; and other persons, if such there be, who, thro'[?^7i] age, infirmity or extreme poverty, in the judg[e]ment of the assessors, are not able to pay towards public charges, they may exempt their polls or estate[s], or abate part of what they are set at, as they on their oaths shall think to be just and equitable. [Sect. 3.] And the justices in their general sessions, in their respective counties assembled, in granting a county tax or assessment, are hereby ordered and directed to apportion the same in the several towns and other places in such county, in proportion to this tax ; and the assessors in each town in this state are also directed, in making a town tax or assessment, to govern themselves by the same rule ; and the incomes of all estates, both real and personal, lying or being within the limits of such town or other place, or next unto the same, not paying elsewhere, in whose hands, tenure, occupation or possession the same is or shall be found, and also the income or profits which any person or persons, except as before excepted, do or shall receive from money at interest more than he or she pay interest for, or from any trade or faculty, business or employment whatsoever, and all profits which shall or may arise by money, or commissions of profits, in their improvement, at so much on the pound as together with what is set on the poll will make up the sum set and ordered hereby for each town or other place to pay ; and in making said assessment, to estimate houses and lands and other real estate, at the amount of six years' yearly rent, whereof the same may reasonably be set or let for in the place where they lie, exclusive of necessary and ordinary repairs ; the said houses and lands to be taxed to such persons as were the actual tenants thereof upon the first day of September last: saving all agreements between landlord and tenants, and where no agreement is, the landlord to reimburse one-half of the tax (new cleared lands for tillage not to be rated until[7] the first crop be taken off) ; and to estimate every ox of four years old and upwards, at forty shillings ; every cow or heifer at three years old and upwards, at thirty shillings ; and every horse or mare of three years old and upwards, at forty shillings ; and every swine of one year old and upwards, at eight shillings ; and every goat and sheep of one year old and upwards, at three shillings ; the several beasts afoi3mention[e]'d to be taxed to their respective owners, by the assessors of the town in which the owners dwell; and all money at interest, either within or without the state, due to persons within this state, at three times the yearly lawful interest thereof, and also the extraordinary business, employment or commissions of profit, at three times the sum of such extraordinary incomes : likewise requiring the assessors to make a fair list of said assessment, setting forth, in distinct columns, against each particular person's name, how much he or she is assessed at for polls, and how much for houses and lands, and how much for personal estate, and income by trade and faculty, and if as guardian, or for any estate in his or her improvement, in trust, to be distinctly expressed ; and the list or lists so perfected, aud signed by them, or the major part of them, to commit to the collector or collectors, constable or constables, of any such town or other place, and to return a certificate of the name or names of such collector or collectors, constable or constables, with the sum total to each of them committed, unto himself, some time before the twentieth day of February next. [Sect. 4.] And the treasurer for the time being, on receipt of such certificate, is hereby impowered and ordered to issue forth his warrants to the collector or collectors, constable or constables, of such town or other place, requiring him or them, respectively, to collect the whole of each respective sura assessed on each particular person, and to pay in their collection, and to issue their accounts of the whole, at or before the first day of May next, which will be in the year of our Lord one thousand seven hundred and seventy-seven. Provided, nevertheless, - And be it further enacted, [Sect. 5.] That the several officers and soldiers now in the army shall be consider[e]'d as resident in the several towns to which they belonged at the time of their engaging in the army, their absence notwithstanding ; and the assessors of the several towus and other places in this state shall consider such officers and soldiers as residents in such towns, and tax them accordingly : provided, also, that such as engaged in the Continental Army before the first day of May last, and have continued in the service until[Z] this time, or have been regu-larl}- discharged, be, and they hereby are, exempted from their poll tax. And be it further enacted, [Sect. 6.] That the assessors of each town or other place, respectively, in convenient time before their making the assessment, shall give seasonable warning to the inhabitants, in a town meeting, or by posting up notifications in some place or places in such town or other place, or notify the inhabitants some other way, to give and bring in to the assessors true and perfect lists of their polls, and the rateable estates which they were possessed of on tne first day of September last, and income by trade or faculty, and gain by money at interest, which they are to render to the assessors, on oath, if required ; and if they refuse to give in an account of the money at interest, on oath, the assessors are impowered to doom them ; and if any person or persons shall, upon such notice given, neglect or refuse to give in to the assessors the list of their polls and rateable estates which they were possessed of on the said first day of Sept[em')e]r iast, or shall bring in a false list and shall be convicted thereof before the said assessors, it shall be lawful to and for the assessors, to assess such per- son or persons, according to their known ability in such town, in their sound judgment and discretion, their due proportion of this tax, as near as they can, agreeable to the rules herein given. And if any person or persons shall not bring in a list of their estates, as aforesaid, to the assessors, he or they so neglecting shall not be admitted to make application to the court of general sessions, for any abatement of the assessment laid on him or them. [Sect. 7-] And if the person be not convicted of any falsehood in the list, by him presented, of the polls, rateable estate[.s], or income by trade or faculty, business or employment, or otherwise, such list shall be a rule for such person's proportion to the tax which the assessors may not exceed. Provided, nevertheless, - [Sect. 8.] That nothing in this act shall extend or be construed to extend so as to require any assessors to assess any person or persons, not belonging to this state, in the service of the United States, who may be found resident in any town in this state, either for their polls, or rateable estate, real or personal, which they had in their possession on the said first day of September by virtue of any commission, office or employment of the United States, or the particular service of this state or any person belonging to this state, for any estate, real or personal, occupied or possessed by him or them to the use of this state by virtue of any order or appointment of the Congress, or general court, or any committee of correspondence or inspection, or selectmen of any town.
