Chap. 814. declared to be an emergency law, necessary for the immediate preservation of the public convenience. Be it enacted, etc., as follows: ' Skction 1. The third paragraph of section 3 of chapter 128A'of the General Laws is hereby amended by striking out clause (d), as most recently amended by section 1 of chapter 721 of the acts of 1971. Section 2.. Said, third paragraph of said section 3 of said chapter 128A is hereby further amended by striking out clause (j), as most recently amended by chapter 986 of the acts of 1971 and inserting in place thereof the following clause: — (j) No licenses shall be issued for more than an aggregate of one hundred and fifty racing days in any one year at the harness horse racing meetings combined, not including harness horse racing meetings at state or county fairs, provided, however, that not less than ninety racing days shall be held during the months of January, February, March and December in any calendar year. No license shall be issued to permit harness horse racing meetings to be held atythe same time that a dog racing meeting or a running horse racing meeting is being held at a race track within ten miles of the track at which such harness horse racing meeting is to be held. Except for harness horse racing meetings at state or county fairs, no license shall be issued to permit harness horse racing, meetings to be held or conducted at the same time within twenty-five miles of another harness horse racing meeting. An Act authorizing the department of public works to dredge a harbor, establish a harbor anchorage, construct dockage facilities and all appurtenances at taylor's point, buzzards bay in the town of BOURNE. Be it enacted, etc.; as follows: Section 1. The department of public works, acting through its division of waterways, is hereby authorized to dredge a harbor, establish a harbor anchorage and construct dockage facilities which may include a marina with berths for approximately one hundred sixty boats and one hundred fifty parking spaces, also including a service dock, fueling station, service building, boat ramp and launching well and such other related facilities as- said department may determine in Buzzards Bay at Taylor's point in the town of Bourne. No work shall be begun until the town of Bourne has assumed liability, in the manner provided by section twenty-nine of chapter ninety-one of the General Laws, for all damages that may be incurred hereunder,, nor until said town has paid its share of the cost of the project, as determined by said department, into the state treasury, ' ' Section 2. Said department is hereby further authorized to accept and spend any federal survey or planning advances or construction grants which may be available for the purposes of this act. Said department and said town are each authorized to do such acts and enter into such contracts as may be necessary or desirable to obtain such federal aid. ' Approved July 20, 1972.
