Chapter 84. AN ACT AUTHORIZING THE TOWN OF HARVARD TO CONVEY A CERTAIN PARCEL OF LAND IN SAID TOWN TO ROBERT J. PENA AND DANA W. FAIRBANKS. Be it enacted, etc., as follows: SECTION 1. The town of Harvard, acting by and through its conservation commission, is hereby authorized to convey to Robert J. Pena and Dana W. Fairbanks a certain parcel of land located on Brown Road in the town of Harvard, containing VA acres of land, more or less, being Parcel 21 on Assessor's Map 35 which is the portion located in the town of Harvard being Parcel 4 in a deed to the Harvard conservation commission, recorded in the Worcester county registry of deeds, Book 6400, Page 203, excepting therefrom a strip of land thirty-five feet wide adjacent to and along the northerly boundary of said Parcel 21 but granting to said Pena and Fairbanks the right to pass and repass over said thirty-five foot wide strip and to use the same for all purposes for which driveways are commonly used in the town of Harvard, including installation of utilities to serve the remaining land of Pena and Fairbanks over, across, and under said strip of land, and also to grant easements to utility companies for the same purpose. SECTION 2. In consideration of the conveyance in section one Robert J. Pena and DanaW. Fairbanks shall convey to the inhabitants of the town of Harvard, for conservation purposes, all their right, title and interest in a certain parcel of land identified as Parcel 23 on Assessor's Map 35, located in the town of Harvard, being the Harvard portion of the "Brown Lot", so-called, which is located off Brown Road, containing 4.1 acres, more or less, together with a strip of land thirty-five feet wide running adjacent to and along the northerly boundary of Assessor's Map 35, Parcel 22, from Parcel 21 to said Parcel 23. Said Parcel 23 is a portion of the land described in a deed recorded in Worcester county registry of deeds in Book 10022, Page 193, and Book 11041, Page 251, reserving however to Pena and Fairbanks the right to pass and repass over said thirty-five foot strip of land and to use the same for all purposes for which driveways are commonly used in the town of Harvard, including installation of utilities to serve the remaining land of Pena and Fairbanks over, across and under said strip of land, and also to grant easements to utility companies for the same purpose.
