Chap. 493. AN ACT AUTHORIZING THE CITY OF BEVERLY
TO ACQUIRE EASEMENTS FOR THE CONSTRUCTION OF CERTAIN SEWERAGE FACILITIES.
Be it enacted, etc., as follows:
The city of Beverly, by its board of aldermen for the purposes of the construction, laying, maintenance and operation of new and enlarged main sewers, pumping stations and other related facilities, is hereby authorized to take by eminent domain under the provisions of chapter seventy-nine of the General Laws or acquire by lease, purchase or otherwise, permanent easements through, across, over and under certain park lands in the city of Beverly, each parcel being more particularly bounded and described as follows:
LAND SHOWN AS PE-22 ON A PLAN BY CULLINAN ENGINEERING CO., INC., TITLED "Proposed Easement for City of Beverly", Sheet 5 of 6 and dated June 4, 1983, bounded and described as follows:
Beginning at a point on the southwesterly sideline of Porter Street Extension, at the most southeasterly corner of the easement to be described, said point being N 31° 31' 18" W and 183.25 feet from an angle point in Porter Street Extension opposite the northerly sideline of Webber Avenue;
THENCE through land now or formerly of The City of Beverly, the following three (3) courses;
S 53° 14' 49" W, a distance of 126.21 feet to a point; N 07° 45' 11" W, a distance of 17.15 feet to a point;
and N 53° 14' 49" E, a distance of 119.26 feet to a point on the southwesterly sideline of Porter Street Extension;
THENCE S 31° 31' 18" E along said southwesterly sideline, a distance of 15.06 feet to the point of beginning;
The above described easement contains 1,841 square feet, more or less.
LAND SHOWN AS PE-35 ON SAID PLAN, SHEET 4 OF 6 AND DATED MAY, 16,1983, BOUNDED AND DESCRIBED AS FOLLOWS:
Beginning at a point on the southerly sideline of Elliott Street at the most northeasterly corner of the easement to be described; said point being N 66° 26' 05" W and 85.60 feet from the intersection of said southerly sideline of Elliott Street and the westerly sideline of Park Street;
THENCE S 22° 42' 18" W along lands of various owners as shown on said plan, a distance of 244.58 feet to a point;
THENCE S 15° 30' 42" W along lands of now or formerly of City of Beverly and Marianna Pasquarelli, a distance of 113.48 feet to a point on the northerly sideline of Roundy Street;
THENCE N 74° 27' 22" W along said northerly sideline of Roundy Street, a distance of 70.26 feet to a point;
THENCE N 23° 33' 55" E in part th rough land now or formerly of aforesaid City of Beverly and in part along land now or formerly of Kenneth T. Deschene, Trustee of The B & K Realty Trust, a distance of 366.71 feet to a point on the aforesaid southerly sideline of Elliott Street;
THENCE S 66° 26' 05" E along said southerly sideline of Elliott Street, a distance of 50.00 feet to the point of beginning;
The above described easement contains 19,941 square feet, more or less.
LAND SHOWN AS PE-36 ON SAID PLAN, SHEET 6 OF 6, AND DATED JUNE 6, 1983, BOUNDED AND DESCRIBED AS FOLLOWS:
Beginning at a point on the westerly sideline of McKay Street; said point being the intersection of said westerly sideline of McKay Street and the southerly sideline of Balch Street extended;
THENCE S 13° 41' 36" E along said westerly sideline of McKay Street, a distance of 358.35 feet to a point; said point being the most northeasterly corner of the easement to be described and the True Point of Beginning;
THENCE S 13° 4V 36" E along said westerly sideline of McKay Street, a distance of 27.36 feet to a point;
The following seventeen (17) courses running through land now or formerly of The City of Beverly:
S 52° 21' 21" W, a distance of 155.55 feet to a point;
S 83° 29' 44" W, a distance of 214.64 feet to a point;
S 77° 00' 19" W, a distance of 316.08 feet to a point;
N 26° 02' 54" W, a distance of 231.53 feet to a point;
N 40° 23' 25" W, a distance of 380.25 feet to a point;
N 48° 35' 27" W, a distance of 437.95 feet to a point;
N 11° 33' 13" W, a distance of 365.60 feet to a point;
N 19° 31' 50" W, a distance of 289.59 feet to a point;
N 41° 10' 42" E, a distance of 28.66 feet to a point;
S 19° 3V 50" E, a distance of 305.36 feet to a point;
S 11° 33' 13" E, a distance of 358.97 feet to a point;
S 48° 35' 27" E, a distance of 431.37 feet to a point;

The above described easement contains 59,400 square feet, more or less.
