Chap. 712. AUTHORIZING THE TOWN OF NORWOOD AND THE COUNTY COMMISSIONERS OF NORFOLK COUNTY TO RELOCATE AND CONSTRUCT AN EXTENSION OF UNIVERSITY AVENUE IN THE TOWN OF NORWOOD. Be it enacted, etc., as follows: SECTION 1. The town of Norwood and the county commissioners of Norfolk county are hereby authorized to make a taking of parcel A as shown on said plan referred to in section seven and including a temporary easement of fifteen feet, also shown on said plan, for the purpose of widening and construction University avenue. Said parcel A is wellfield land, owned by the town of Norwood, and is bounded and described as follows:- Beginning at a point at station 65 + 13.30 on the easterly side of University Avenue (Town Layout of October 27, 1966), thence running northwesterly by a curve radius 970.00 feet a distance of 533.40 feet; thence running N45-36-00W a distance of 3.71 feet to a concrete bound, thence running N45-52-00W a distance of 52.01 feet, thence running along the side line of University Avenue by a curve of radius 770.00 feet, a distance of 458.33 feet, thence running along the side line of University Avenue S34-54-48E a distance of 129.88 feet to a point, said point being the terminus of the lines of this taking and said point being the same as the beginning point of the lines of this taking, said parcel containing 12,586 square feet, more or less. SECTION 2. The town of Norwood and the county commissioners of Norfolk county are hereby authorized to transfer to William J. Walker and Francis J. Perry, as they are trustees of the Everett Street Trust, or their successors in title, that portion of Everett street in said town, which will be abandoned upon the relocation of said street, and a certain parcel of land shown as parcel C. Said parcel C is wellfield land and is bounded and described as follows:- Beginning at a point at station 18 + 96.16 on the southerly side of Everett Street (County layout of March 8, 1955); thence running along the side line of Everett Street S71-35-30E a distance of 122.93 feet, thence along the side line of Everett Street southeasterly by a curve of radius 1460.00 feet a distance of 6.62 feet, thence running southwesterly by a curve of radius 846.00 feet a distance of 18.26 feet, thence running southwesterly, westerly and northwesterly by a curve of radius 100.00 feet a distance of 97.32 feet, thence running northwesterly by a curve of radius 1032.00 feet a distance of 22.25 feet to a point, said point being the terminus of the lines of this taking and said point being the same as the beginning point of the lines of this taking, containing 1,763 square feet, more or less. Said transfer is to be in lieu of damages for the taking of Parcel 1, containing 19,663 square feet, and Parcel 2, containing 18,909 square feet, both parcels being shown on the plan which is a part of the said petition of John F. Kinnaly and both parcels are needed for the widening of said Everett Street between University Avenue and U.S. Route 1, also known as the Blue Star Memorial Highway. SECTION 3. The town of Norwood and the county commissioners of Norfolk county are hereby authorized to make a taking of parcel D as shown on said plan referred to in section seven of this act, including a temporary easement of fifteen feet which is also shown on said plans, for the layout and construction of the relocations of Everett street and University avenue. Said parcel D is wellfield land, owned by the town of Norwood and is bound and described as follows: - Beginning at a point at station 20 + 66.40 on the southerly side of Everett Street (County layout of March 8, 1955), thence running along the side line of Everett Street S71-35-30E a distance of 170.24 feet; thence running southeasterly by a curve of radius 1032.00 feet a distance of 22.25 feet; thence running southeasterly, easterly and northeasterly by a curve of radius 100.00 feet a distance of 97.32 feet, thence running northeasterly by a curve of radius 846.00 feet a distance of 18.26 feet; thence running along the side line of Everett Street southeasterly by a curve of radius 1460.00 feet a distance of 40.78 feet; thence running along the side line of American Drive southeasterly by a curve of radius 42.00 feet a distance of 10.76 feet; thence running S62-43-07W a distance of 155.35 feet; thence running northwesterly by a curve of radius 970.00 feet a distance of 267.92 feet to a point, said point being the terminus of the lines of this taking and said point being the same as the beginning point of the lines of this taking, said parcel containing 16,189 square feet, more or less. SECTION 4. The town of Norwood is hereby authorized to transfer to Steel Sales Realty Company that parcel of land, shown as parcel E on said plan referred to in section one of this act. Said Parcel E is wellfield land and is bounded and described as follows: - Beginning at a point at Station 20 + 73.40 on the southerly side of Everett Street (County layout of March 8, 1955); thence running along the side line of Everett Street S71-35-30E a distance of 7.00 feet, thence running southeasterly by a curve of radius 970.00 feet a distance of 267.92 feet; thence running S62-43-07W a distance of 119.62 feet, thence running northwesterly by a curve of radius 400.00 feet a distance of 262.41 feet to a point, said point being the terminus of the lines of this taking, and said point being the same as the beginning point of the lines of this taking, said parcel containing 13,695 square feet, more or less. Said transfer is to be made in lieu of damages for the taking by the town of Norwood of certain land, owned by Steel Sales Realty Company, bounded and described as follows:- Beginning at a point on the westerly side of American Drive, said point being southwesterly a distance of 10.76 feet by a radius of 42.00 feet from station 17 + 26.80 (County layout of March 8, 1955) on the southerly side of Everett Street; thence running southeasterly, southerly and southwesterly by a curve of radius 42.00 feet a distance of 51.10 feet; thence running S10-55-50W a distance of 119.68 feet, thence running southwesterly, southerly and southeasterly by a curve of radius 250.00 feet a distance of 165.81 feet; thence running S27-04-10E a distance of 209.91 feet; thence running southeasterly by a curve of a radius 600.00 feet a distance of 133.00 feet; thence running S80-45-56W a distance of 10.39 feet; thence running northwesterly by a curve of radius 970.00 feet a distance of 195.17 feet; thence running N27-04-10W a distance of 239.45 feet; thence running northwesterly by a curve of radius 970.00 feet a distance 202.37 feet; thence running N62-43-07E a distance of 155.35 feet to a point, said point being the terminus of the lines of this taking and said point being the same as the beginning point of the lines of this taking, said parcel containing 22,669 square feet more or less is shown as parcel 8. SECTION 5. The order of taking by a town of Norwood for the layout of American Drive, also known as University Avenue, dated November 29, 1966 and recorded in the Norfolk county registry of deeds in Book 4402, Page 515, and as Document NO. 279417 in the registry district of the land court in Dedham and shown on Plans 1230 through 1232, inclusive, in Plan Book 221 in said Norfolk county registry of deeds, and the laying out and acceptance of said University avenue, including the taking, layout and acceptance of Parcel B on said plans, are hereby ratified and confirmed insofar as may be necessary above and beyond the ratification granted by chapter six hundred and nineteen of the acts of nineteen hundred and eighty-one, insofar as it relates to the wellfields in said town of Norwood. Said Parcel B is wellfield land and is bounded and described as follows :- Beginning at a point at station 65 ? 50.00 on the easterly side of University Avenue (Town Layout of October 27, 1966), thence running N34-54-48W a distance of 93.18 feet; thence running northwesterly by a curve of radius 770.00 feet a distance of 458.33 feet, thence running N45-52-00W a distance 81.91 feet; thence running southeasterly by a curve of radius 830.00 feet a distance of 551.96 feet, thence running S34-54-48E a distance of 93.18 feet, thence running N55-05-12E a distance of 60.00 feet to a point, said point being the terminus of the lines of this taking and said point being the same as the beginning point of the lines of this taking, said parcel containing 35,918 square feet, more or less. SECTION 6. Said town of Norwood and the said county commissioners of Norfolk county are hereby authorized to do any and all other things reasonably necessary for the laying out, relocation and construction of University avenue as well as the laying out, relocation and construction of Everett street as shown on said plan referred to in section seven of this act. SECTION 7. The parcels A,B,C,D,E, and 8 referred to hereinafter are those shown on the plan being a part of the "Petition of John F. Kinnaly and others, petitioners for the relocation of Everett Street, American Drive and University Avenue, Norwood, Massachusetts", which petition was received by said county commissioners on September 14, 1981, under Docket No. 1700. SECTION 8. This act shall take effect upon its passage. Approved December 29, 1983.
