Chap. 96. AN ACT AUTHORIZING THE DIVISION OF CAPI- TAL PLANNING AND OPERATIONS TO LEASE CERTAIN FACILITIES AT THE MOUNT GREYLOCK STATE RESERVATION. Be it enacted, etc., as follows: The deputy commissioner of the division of capital planning and operations is hereby authorized to lease for a period of not more than twenty years to the Northern Berkshire Amateur Radio Club, Inc., facilities at the Mount Greylock reservation in the town of Adams for the purposes of amateur radio communication. Such facilities shall include use of a monopole antenna located adjacent to Bascom Lodge on said reservation, and use of space within said Bascom Lodge. Said lease shall commence on or about August twenty-third, nineteen hundred and eighty-four, and shall have a renewal date of not less than one year prior to the end of the lease period. Said lease shall contain a fair leasing fee as determined by said deputy commissioner and shall (a) stipulate that the use of the facilities by the Northern Berkshire Amateur Radio Club, Inc., shall be contingent upon said club's agreement to maintain emergency radio communications in support of the emergency communications systems of the commonwealth, to provide for equipment maintenance, and to carry liability insurance relative to the leased facilities, and (b) that the Northern Berkshire Amateur Radio Club, Inc., shall not sublet any of its privileges to any other party. Nothing in this act shall prohibit said deputy commissioner and the Northern Berkshire Amateur Radio Club, Inc., from making agreements as part of said lease which establish standards of safety, liability, and equipment maintenance in conjunction with amateur radio operations at the Mount Greylock Reservation.
