Chap. 0110 An Act to authorize the appointment of a special judge of prorate and insolvency in each of the counties of berkshire and hampden. Be it enacted, etc., as follows: Section 1. A special judge of probate and insolvency shall be appointed in each of the counties of Berkshire and Hampden, who may perform the duties of the judge of probate and insolvency in the county for which he is ap- pointed, in cases of vacancy in office, sickness, disability on account of interest of such judge, or whenever the judge in a writing riled with the register requests the special judge to perform his duties; or, in case of the absence of the judge from the county, whenever the register, in a writing certifying such absence, shall so request. Section 2. Whenever the special judge holds a session of the probate court or of the court of insolvency because of vacancy in the office of judge or because of the sickness or interest of the judge, he shall receive from ihe commonwealth the same compensation that a judge of probate and insolvency for another county would be entitled to receive for the same service. The register shall certify upon the records of the court the number of days, ihe dates upon which, and the occasions for which the duties of the judge are performed by the special judge; and when the occasion is that of sickness, interest or vacancy in office, he shall certify ihe same to the auditor of the commonwealth. Section o. This act shall take effect upon its passage. Approved February 24, 190S.
