Chap. 0462 An Act relative to the granting of old age assistance to recipients who remove to another community. Be it enacted, etc., as follows: Section 1. Section 8 of chapter 118A of the General Laws, as most recently amended by chapter 539 of the acts of 1951, is hereby further amended by striking out the last sentence and inserting in place thereof the following four sentences: - In the event a person who is in receipt of assistance under this chapter removes to another town in the commonwealth and remains in need of continued assistance, the town of his former residence shall be responsible for the rendering to him of such assistance as shall be necessary until the end of the first full month after his removal; provided, however, that upon the removal of an old age assistance recipient to another town for the purpose of entering an incorporated home, boarding or nursing home, hospital, or a public medical institution as denned in section one B, the town in which such person last maintained a residence shall grant and continue assistance to such person until the need for such assistance is terminated. In the event that an applicant for assistance under this chapter is a patient in an incorporated home, boarding or nursing home or hospital at the time when application for assistance is made, the application shall be taken in the town in which such incorporated home, boarding home or nursing home or hospital is located. If the applicant has a settlement in the commonwealth the place of settlement shall be notified and that place shall aid the recipient if eligible. If such person has no legal settlement in the commonwealth, application shall be made in the town in which he last maintained a residence outside of an institution. Section 2. Except as otherwise provided, the town granting assistance on the effective date of this act shall be the town responsible for granting and continuing assistance until the need for such assistance is terminated.
