Chap. 901. An Act providing for the transfer by the commissioner OF MENTAL HEALTH OF CERTAIN PROPERTY IN THE CITY OF WORCESTER TO THE BOARD OF TRUSTEES OF THE UNIVERSITY OF MASSACHUSETTS FOR THE UNIVERSITY OF MASSACHUSETTS MEDICAL SCHOOL. Be it enacted, etc., as follows: Section 1. The commissioner of mental health, in the name and on behalf of the commonwealth, is hereby authorized and directed to transfer and convey to the board of trustees of the University of Massachusetts, hereinafter called the trustees, without consideration, two parcels of land located in the city of Worcester and bounded and described as follows: — Parcel A. Beginning at a point in the westerly sideline of Plantation Street, said point marking the southeasterly corner of land conveyed to Notre Dame Institute by deed recorded in Worcester District Deeds Book 1640 at Page 175 and the northeasterly corner of Parcel A described herein; thence southerly by the westerly sideline of Plantation Street to a point in the northerly sideline of Belmont Street; thence westerly by the northerly sideline of said Belmont Street a distance of 649.81 feet, more or less, to a point; thence North 3 degrees 10 minutes 15 seconds West a distance of 149.36 feet, more or less, to a point; thence North 20 degrees 50 minutes 30 seconds West a distance of 161.50 feet to a point; thence North 11 degrees 28 minutes 06 seconds West a distance of 195.03 feet to a point; thence South 77 degrees 58 minutes 30 seconds East a distance of 55.84 feet to a point; thence North 42 degrees 17 minutes 40 seconds East a distance of 1777.28 feet to a point; thence North 4 degrees 12 minutes 20 seconds East a distance of 195.54 feet to a point; thence North 0 degrees 45 minutes 00 seconds East a distance of 250.45 feet to a point; thence North 7 degrees 38 minutes 50 seconds West a distance of 288.71 feet to a point; thence North 15 degrees 38 minutes 45 seconds West a distance of 1055.09 feet to a 748 Acts, 1965. — Chap. 901. point; thence North 83 degrees 00 minutes 00 seconds West a distance of 461.28 feet to a point; the last ten courses being by land of the department of mental health; thence North 21 degrees 04 minutes 00 seconds West a distance of 287.35 feet to a point; thence North 52 degrees 10 minutes 50 seconds West a distance of 247.05 feet to a stone bound; thence North 34 degrees 56 minutes 10 seconds East a distance of 22.29 feet to a stone bound; thence North 66 degrees 40 minutes 00 seconds East a distance of 833.90 feet to a point; the last four courses being by land of city of Worcester known as Green Hill Park; thence South 43 degrees 22 minutes 40 seconds East a distance of 739.50 feet to a point; thence South 67 degrees 21 minutes 50 seconds East a distance of 730.17 feet to the point of beginning the last two courses being by land of said Notre Dame Institute; containing 75.86 acres, more or less. Parcel B. Beginning at a point in the easterly sideline of Plantation Street, said point marking the southwesterly corner of land conveyed to Louis P. and Rita L. Mercadante by deed recorded in Worcester District Deeds Book 4129 at Page 254 and the northwesterly corner of the parcel described herein; thence North 79 degrees 32 minutes 10 seconds East by land of said Mercadante, land now or formerly of Peter Stapor, and land now or formerly of Joseph A. Donovan a distance of 1752.82 feet to a point in the westerly sideline of Lake Avenue North; thence southwesterly and southerly by the westerly sideline of said Lake Avenue North through two concrete bounds, each marked W. H., to a point South 3 degrees 14 minutes 03 seconds West a distance of 812.26 feet from the southerly of said bounds; thence South 85 degrees 52 minutes 10 seconds West a distance of 199.09 feet to a stone bound; thence South 40 degrees 55 minutes 30 seconds West a distance of 585.46 feet to an iron pipe, the last two courses being by land of the department of public works and formerly of the department of mental health; thence North 82 degrees 36 minutes 20 seconds West by land of the division of youth service and land of St. George's Syrian An-tiochian Orthodox Church of Worcester, said land being formerly of the department of mental health, a distance of 1223.69 feet to a point-in the easterly sideline of Plantation Street; thence northerly by the easterly sideline of Plantation Street to the point of beginning;; > containing 48.6 acres, more or less. Section 2. The trustees are' hereby authorized to use the land transferred and conveyed under section one, and buildings, structures and facilities now or hereafter located thereon, for the University of Massachusetts medical school and for uses related thereto, and shall have custody and control of such land and all such buildings, structures and facilities; provided, however, that the department of mental health shall retain the right of access to and custody and control of, and shall be responsible for the operation and maintenance of, all buildings and structures now on such land until, as to each such building and structure, twelve months after the trustees shall have given the commissioner of mental health notice in writing of their intention to utilize such building or structure, or the land upon which it stands, for the use of said medical school.1 V Section 3. The trustees shall not sell, convey or transfer any part of the land to be transferred and conveyed in section one. If they shall "hereafter determine that any part of such land is no longer required for Acts, 1965. — Chaps. 902, 903. 749 said medical school, they shall give notice in writing to the commissioner of mental health of such determination, which notice shall refer to this section and shall include a description of the part no longer required, whereupon such part shall revert to the custody and control of the department of mental health. Section 4. The commissioner of mental health shall not sell, convey or transfer any part of the land retained as the grounds for the Worcester state hospital unless he first shall have offered in writing to transfer and convey said part to the trustees.
