Chap. 723. AN ACT PROVIDING FOR A CAPITAL OUTLAY PROGRAM FOR THE COMMONWEALTH. Be it enacted, etc.. as follows: SECTION 1. To provide for a program of studies, preparation of plans, construction, reconstruction, alteration and improvement of various state institutions and properties, and for the purchase of certain property, including the purchase of furnishings, equipment and motor vehicles, the sums set forth in sections two to eight, inclusive, nine to nine T, inclusive, ten, ten B, and thirteen to thirteen B, inclusive, of this act, for the several purposes and subject to the conditions specified under the provisions of this act in sections two to forty-nine, inclusive, are hereby made available, subject to the provisions of law regulating the disbursement of public funds and the approval thereof. SECTION 2. Section 2 of chapter 798 of the acts of 1979 is hereby amended by striking out item 2120-9801, as amended by section 1 of chapter 512 of the acts of 1980, and inserting in place thereof the foI Iowi ng i tern:- For acquisition and development and associated costs in connection with the establishment of Urban Heritage State Parks in the cities of Fall River, North Adams, Gardner, Holyoke, Lawrence, Lynn, Marlborough, Springfield, and WaItham, in the Turners Falls district of the town of Montague, in the Dorchester, Roxbury, and AlIston-Brighton districts of the city of Boston, and in the Blackstone River and Canal Heritage State Park, including the cost of furnishings and equipment, and including equipment of historical significance; provided, that this item shall not be subject to the provisions of section forty of chapter seven of the General Laws; and provided, further, that any federal funds available for the purposes of this item may be expended without further appropriation; and for the purpose of entering into agreements with the municipalities named herein or with redevelopment authorities organized pursuant to section four of chapter one hundred and twenty-one B of the Ceneral Laws or economic development and industrial corporations organized pursuant to section three of chapter one hundred and twenty-one C of the Ceneral Laws in the said municipalities or in the case of the city of Lynn, the economic development and industrial corporation of Lynn established pursuant to chapter seven hundred and seventy-eight of the acts of nineteen hundred and seventy-seven, for the purpose of acquisition, development and associated costs in connection with the establishment of said parks $22,000,000 SECTION 35. I tern 2320-9812 of section 2 of chapter 578 of the acts of 1980 is hereby amended by striking out the wording and inserting in place thereof the following:- For the acquisition of a parcel of land in the town of Cheshire located at the south end of Cheshire Lake and for the acquisition of Cheshire Lake, and for the design and construction of a public access boat launching ramp, access road and parking area. SECTION 36. I tern 7504-8811 of said section 2 of said chapter 578 is hereby amended by striking out the wording and inserting in place thereof the following:- For renovation including the cost of furnishings and equipment at existing campus for a lecture/demonstration kitchen facility. SECTION 37. Item 7515-8811 (8081-80) of said section 2 of said chapter 578 is hereby amended by striking out the wording and inserting in place thereof the following:- ACTS, 1963. Chap. 723. For the acquisition of certain land or land with buildings thereon in the southwest corridor site of the Roxbury section of the city of Boston by purchase or by eminent domain under chapter seventy-nine of the General Laws for the development of the campus for the Roxbury Community College, provided that no payment shall be made for the purchase of said property until an Independent appraisal of the value of the property has been made by a qualified disinterested appraiser and including the relocation of owners and occupants thereon and the demolition of certain buildings and for the preparation of plans and the construction of college campus facilities; including the cost of furnishings and equipment; provided, further, that the unexpended balances remaining in item 8071-73 (7515-8711) of section two of chapter six hundred and thirty-three of the acts of nineteen hundred and seventy is hereby transferred and made available for this purpose; and provided, further, that such funds are available for expenditure until June thirtieth, nineteen hundred and eighty-eight. SECTION 38. Section 5 of said chapter 578 is hereby amended by striking out item 2440-6811. ' SECTION 39. Section 12 of said chapter 578 if hereby amended by striking out, in line 4, the words "twenty mi 11 Ion" and Inserting in place thereof the words:- seventeen million five hundred. SECTION 40. Chapter seven hundred and thirty-six of the acts of nineteen hundred and eighty-one is hereby repealed. SECTION 41. Chapter 789 of the acts of 1981 is hereby amended by inserting after section 15 the foI IowIng sect f on:- Section 15A. Pursuant to the program established by section five of this act the department of community affairs is hereby directed to grant the city of Springfield a sum not to exceed one million three hundred thousand dollars for the purpose of improving the sewerage system of said city, and is hereby further directed to grant the city of Woburn a sum not to exceed three hundred twenty-five thousand dollars for the purpose of improving the water delivery system of said city. SECTION 42. The second paragraph of section 20 of said chapter 789 is hereby amended by striking out, in line 2, the word "fifty" and inserting in place thereof the word:- thirty. SECTION 43. The first paragraph of section 21 of said chapter 789 is hereby amended by striking out, in line 6, the word "fifty" and inserting in place thereof the word:- thirty. SECTION 44. Item 2270-0503 of section 2 of chapter 191 of the acts of 1982, as amended by section 17 of chapter 204 of the acts of 1983, is hereby further amended by striking out the wording and inserting in place thereof the following wording:- For a continuous program of cleaning of harbors and inland waterways, as authorized by chapter eight hundred and seventy-eight of the acts of nineteen hundred and seventy, provided, that a sum not exceeding four hundred and seventy-five thousand dollars, to be in addition to any amounts deposited with the state treasurer pursuant to section four D of chapter forty of the General Laws, shall be expended to clear and dredge Wellfleet Harbor in the town of Well fleet and to monitor the dredge disposal site and develop a generic environmental impact report on the designation of a regional disposal site for dredged material in Cape Cod Bay; provided, however, that a sum not exceeding thirty-five thousand dollars shall be used to repair and reconstruct the automatic tidat gate located at the headwaters of Straits Pond at the boundaries of the towns of Cohasset, Hingham, and Hull; provided, further, that a sum not exceeding one hundred and fifty thousand dollars shall be used to dredge the Housatonic River and stabilize the stream bank in the vicinity of the Park Street bridge in the village of Housatonic; provided, further, that a sum not exceeding two hundred thousand dollars shall be expended to clear and dredge the Hoosic River and a portion of Kitchen Brook in the town of Cheshire, for stream clearance, and selective excavation and improvements; provided, further, that a sum not exceeding thirty thousand dollars shall be used for the design of flood control and erosion control improvements to a section of the Green River in the town of WiI Iiamstown. SECTION 45. Section 1 of chapter 606 of the acts of 1982 is hereby amended by striking out the last sentence and inserting in place thereof the following sentence:- The divisions of capital planning and operations is hereby authorized to convey and transfer the title of said property referred to in section two of this chapter to the city known as the town of Methuen. SECTION 46. I tern 0431-8833 of section 2 of chapter 649 of the acts of 1982 is hereby amended by striking out the Figure "10,000,000" and inserting in place thereof the figure:- 16,000,000. SECTION 47. Section 3 of chapter 325 of the acts of 1983 is hereby amended by striking out the words "three hundred seventy thousand five hundred and nine" and inserting in place thereof the words:- five hundred thirty-six thousand four hundred and seventy-nine. SECTION 48. Section 48A of chapter 29 of the General Laws, as most recently amended by section 3 of chapter 336 of the acts of 1977, is hereby further amended by striking out the third sentence and inserting in place thereof the following sentence:- If any officer whose signature or a facsimile of whose signature appears on any notes, bonds or coupons shall cease to be such officer before the delivery of, and receipt of proceeds from the borrowing evidenced by, such notes or bonds, such signature or such facsimile shall nevertheless be valid and sufficient for all purposes as if such officer had remained in office until such delivery and receipt of proceeds. SECTION 49. Section 49 of said chapter 29, as most recently amended by section 1 of chapter 34 of the acts of 1982, is hereby further amended by striking out the second paragraph and inserting in place thereof the following paragraph-Bonds of the commonwealth may be issued as registered bonds or as bearer bonds, with or without coupons, as the state treasurer may deem best. Such bonds shall bear interest at such rate or rates as the state treasurer, with the approval of the governor, shall fix. The provisions of this paragraph shall apply to any bonds issued after January first, nineteen hundred and eighty-two unless the act authorizing such issue expressly states that the provisions of this paragraph shall not apply.
