"By an amended complaint filed in 1995, plaintiffs Elizabeth A. Fisher and Howard E. Stempler sued defendant Commonwealth of Massachusetts pursuant to G.L. c. 240, ʹ 11. They asked the Court to determine whether an 1887 deed (Trial Exhibit 6) required them to keep the "ledges and rocks" on their coastal property at 18 Long Branch Avenue in Rockport, MA, "open to the general public."--Paragraph 1.
